OVERVIEW
Welcome to 808 Spec Trailer Rental Services! The terms “we”, “us” and “our” refer to 808 Spec and its representatives. 808 Spec operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). 808 Spec is powered by Shopify, which enables us to provide the Services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
 
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 1 - RENTAL OF TRAILER
Owner rents to Renter, and Renter rents from Owner, the above-described trailer (the "Trailer") subject to all terms in this Agreement. The Trailer is rented solely for lawful, proper, and safe towing and transport of a motor vehicle or other cargo specifically approved in writing by Owner.


SECTION 2 - RENTAL PERIOD
The rental begins on the start and end date selected in Shopify (the "Rental Period").
Renter shall return the Trailer by the agreed return date and time. Any extension must be approved by Owner in writing before the scheduled return time. Unauthorized holdover may result in additional rental charges, late fees, repossession, and any other remedies allowed by law.


SECTION 3 - CHARGES, DEPOSITS, AND PAYMENT
Renter agrees to pay all applicable charges under this Agreement, including the following amounts as stated by Owner:

1. Rental fees: Weekdays (Monday to Friday) $75 per day and Weekends (Saturday and Sunday) $100 per day
2. Security deposit: $300
3. Late return fee: $150 per day after the return deadline
4. Cleaning fee, if applicable, as determined by the owner
5. Damage, loss, repair, towing, storage, administrative, and collection costs
6. Any taxes, government fees, tolls, parking charges, impound fees, or similar amounts arising from Renter's use or possession of the Trailer


SECTION 4 - AUTHORIZED DRIVER AND DRIVER REQUIREMENTS
Only the Renter and any additional driver specifically approved in writing by Owner may tow or possess the Trailer.
1. Be at least 21 years old
2. Hold a valid and current driver's license appropriate for the tow vehicle and trailer combination
3. Have sufficient towing experience or accept all risk associated with towing the Trailer
4. Not be under the influence of alcohol, cannabis, illegal drugs, impairing medication, or any substance affecting driving ability
5. Not have a suspended, revoked, canceled, restricted, or expired license
6. Not permit any third party to tow, move, sub-rent, borrow, or possess the Trailer

The owner reserves the right to keep a copy of the Renter's and any additional driver's license(s) on file.

SECTION 5 - TOW VEHICLE REQUIREMENTS
Renter is solely responsible for ensuring that the tow vehicle is safe, legal, properly registered and insured, and fully capable of towing the Trailer and intended load.
Owner does not verify the suitability of Renter's tow vehicle and makes no representation that the vehicle selected by Renter is appropriate.

1. Tow vehicle must have sufficient manufacturer-rated towing capacity for the Trailer and intended load
2. Tow vehicle must have a properly sized and rated hitch, ball, coupler, receiver, and electrical connection
3. Brake lights, turn signals, running lights, and hazard lights must function properly
4. Tires must be properly inflated and in safe condition
5. Any required trailer brake controller must be installed and functioning
6. Tow vehicle and trailer combination must comply with California law and the laws of every jurisdiction where the Trailer is used

SECTION 6 - CONDITION OF TRAILER AT DELIVERY
Before taking possession, Renter has the opportunity to inspect the Trailer and accepts it in its present condition, except as specifically noted on the pre-rental inspection form.
Owner makes no warranties, express or implied, except as required by law, including no warranty of merchantability or fitness for a particular purpose. Renter is solely responsible for determining whether the Trailer is suitable for Renter's intended use.

SECTION 7 - INSPECTION AT PICKUP AND RETURN
At pickup, the parties should complete and sign a condition report noting the Trailer's condition, tires, lights, deck, ramps, fenders, straps, chains, winch, jack, coupler, and any existing damage.

At return, Owner may inspect the Trailer after it is returned. Renter remains responsible for any loss or damage discovered after return if such loss or damage occurred during the Rental Period.

Photographs and video taken at pickup and return may be used to document condition.

SECTION 8 - PROPER USE OF THE TRAILER
Renter shall use the Trailer only in a careful, lawful, and reasonable manner. Proper use includes, without limitation, the following:

1. Loading only approved cargo within the Trailer's rated capacity
2. Keeping the load properly balanced and distributed
3. Securing all cargo and transported vehicles using proper securement equipment
4. Ensuring the coupler is fully engaged and locked before movement
5. Using safety chains, wiring, jack, ramps, wheel straps, and any other equipment correctly
6. Checking lights, tires, lug nuts, coupler, safety chains, ramps, straps, and securement before departure and periodically during transport
7. Complying with all speed limits, roadway restrictions, bridge limits, weight limits, and towing laws
8. Using the Trailer only on surfaces and routes suitable for this Trailer type and load

SECTION 9 - VEHICLE LOADING AND SECUREMENT
Because this Trailer is an open vehicle hauler, Renter assumes full responsibility for safe loading and securement of any vehicle or cargo.

A winch, if present, is for loading assistance only and is not the sole securement device during transport.
1. The transported vehicle or cargo must not exceed the Trailer's rated capacity
2. The load must be centered and balanced to reduce sway, instability, or loss of control
3. The load must be secured to prevent shifting, rolling, falling, or damage
4. A transported vehicle should be secured using at least four tie-down chains, straps, or equivalent devices independent of the winch or loading cable
5. Edge protection and safe strap routing should be used where needed to avoid cutting, abrasion, or failure
6. Renter should stop and re-check securement as needed during the trip

SECTION 10 - PROHIBITED USES
The following uses are strictly prohibited and constitute a material breach of this Agreement:
1. Towing by an unlicensed, unauthorized, or impaired driver
2. Exceeding the Trailer's GVWR, axle rating, tire rating, hitch rating, or tow rating
3. Transporting hazardous, explosive, illegal, toxic, flammable, or contaminated materials
4. Transporting passengers, animals, or occupied vehicles on the Trailer
5. Off-road use, racing, drifting, stunt driving, or use on unsuitable terrain
6. Using the Trailer for any unlawful purpose
7. Sub-renting, lending, assigning, selling, or transferring possession of the Trailer
8. Removing, altering, covering, or defacing any VIN, plate, decals, tracking device, or identifying marks
9. Taking the Trailer outside the approved geographic area without Owner's written consent
10. Using the Trailer after any warning light, tire issue, brake issue, coupling issue, strap failure, or other unsafe condition appears
11. Repairing, modifying, welding, drilling, repainting, or altering the Trailer without prior written consent
12. Allowing the Trailer to be seized, impounded, abandoned, or confiscated
13. Transporting a vehicle or load that leaks fluids or creates unsafe road conditions unless properly contained and specifically approved by Owner

SECTION 11 - GEOGRAPHIC RESTRICTIONS
The Trailer may be used only within the state of California unless Owner gives prior written consent.

Renter shall not take the Trailer into Mexico or any other prohibited jurisdiction without prior written approval.

SECTION 12 - NO PASSENGERS / NO OCCUPANCY
No person may ride in, on, or upon the Trailer, and no person may remain inside any transported vehicle while loading, unloading, or transporting.

SECTION 13 - ROADSIDE SAFETY AND OPERATING DUTIES
Renter shall stop use immediately if any unsafe condition exists, including tire damage, bearing issues, lighting failure, a loose coupler, broken strap, broken chain, sway, wobble, smoke, abnormal noise, or brake problems.
Renter must take all reasonable steps to protect persons and property and to prevent further damage. Continued operation after discovery of an unsafe condition is entirely at Renter's risk.

SECTION 14 - BREAKDOWNS, MECHANICAL ISSUES, AND REPAIRS
If the Trailer breaks down, is damaged, or becomes unsafe, Renter shall do all of the following:
1. Immediately stop use when safe to do so
2. Notify Owner as soon as possible
3. Not authorize repairs without Owner's prior approval, except emergency measures reasonably necessary to protect life or property
4. Provide photographs, location, and a description of the issue upon request
5. Submit receipts for any approved repair work

SECTION 15 - MAINTENANCE DURING RENTAL
During the Rental Period, Renter is responsible for ordinary care, including checking the following items:
1. Tire inflation and visible tire condition
2. Coupler latch and safety pin
3. Safety chains
4. Light connections and operation
5. Tie-downs and securement devices
6. Ramp locking and storage
7. Wheel lug tightness and other obvious defects, when reasonably observable

SECTION 16 - ACCIDENT, DAMAGE, THEFT, OR LOSS
Renter shall immediately notify Owner of any accident, collision, theft, vandalism, fire, impound, seizure, loss, or damage involving the Trailer.

If an accident occurs, Renter shall call law enforcement if required by law or reasonably necessary, gather relevant contact and insurance information, take photographs or video, avoid admitting fault on behalf of Owner, and promptly send Owner all reports, notices, citations, claims, and related documents.

Renter is fully responsible for all loss of or damage to the Trailer, whether or not caused by Renter's fault, to the fullest extent permitted by law.

SECTION 17 - DAMAGE TO CARGO OR TRANSPORTED VEHICLE
Renter assumes all risk of loss of or damage to any cargo or vehicle loaded onto the Trailer, including during loading, unloading, transport, parking, storage, theft, collision, weather, road debris, strap failure, or shifting of load.

Owner is not responsible for damage to Renter's vehicle, cargo, or any third party's property unless caused solely by Owner's proven willful misconduct or other non-waivable liability under applicable law.

SECTION 18 - LIABILITY FOR THIRD PARTY CLAIMS
Renter is responsible for all claims, losses, injuries, property damage, towing charges, impound charges, storage fees, citations, penalties, legal fees, and expenses arising out of or related to Renter's use, towing, loading, possession, or return of the Trailer, any accident during the Rental Period, any transported cargo or vehicle, any breach of this Agreement, or any negligent or unlawful act or omission by Renter or any authorized or unauthorized user.


SECTION 19 - INDEMNIFICATION
To the fullest extent permitted by law, Renter shall defend, indemnify, and hold harmless Owner and Owner's members, managers, officers, employees, agents, and affiliates from and against any and all claims, demands, suits, liabilities, judgments, losses, fines, penalties, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to the Trailer during the Rental Period or Renter's use, towing, loading, securement, possession, maintenance, storage, or return of the Trailer.

This indemnity survives termination of the Agreement.

SECTION 20 - INSURANCE
Renter shall maintain, at Renter's sole expense, valid automobile liability insurance and any other insurance required by law or reasonably necessary for the tow vehicle, trailer use, and transported vehicle or cargo.
Before release of the Trailer, Owner may require proof of insurance, including declarations pages, endorsements, and confirmation of coverage.
Unless expressly stated in writing, Owner does not provide insurance for damage to the Trailer, damage to cargo or transported vehicles, liability for bodily injury or property damage arising from Renter's use, or theft, vandalism, or loss during the Rental Period.
Any insurance carried by Owner shall be excess only and shall not relieve Renter of any obligation under this Agreement unless otherwise required by law.

SECTION 21 - ASSUMPTION OF RISK
Renter understands that towing and loading an open vehicle hauler involves inherent risks, including sway, rollover, collision, cargo shift, equipment failure, tire failure, loading and unloading incidents, road hazards, weather exposure, and property damage.
Renter voluntarily assumes all risks associated with use of the Trailer, except to the extent caused solely by Owner's non-waivable legal fault.


SECTION 22 - RELEASE OF CLAIMS
To the fullest extent permitted by law, Renter releases Owner from claims for injury, death, loss, or damage arising from the Trailer or its use, except to the extent caused solely by Owner's gross negligence, willful misconduct, or other liability that cannot legally be waived.

Nothing in this Agreement is intended to waive rights or remedies that cannot lawfully be waived under California law.

SECTION 23 - CITATIONS, TOLLS, IMPOUND, AND ADMINISTRATIVE FEES
Renter is responsible for all tolls, tickets, parking violations, red-light or toll camera charges, towing charges, storage charges, impound fees, and other government or third-party charges incurred during the Rental Period.

If Owner pays or processes any such charge, Renter shall reimburse Owner for the amount paid.

SECTION 24 - LATE RETURN, FAILURE TO RETURN, AND ABANDONMENT
If Renter fails to return the Trailer when due, Owner may charge additional rent and late fees, report the Trailer as unlawfully withheld if permitted by law, repossess the Trailer without prior notice where lawful, charge Renter for all recovery, repossession, towing, locksmith, storage, administrative, and legal costs, and treat the failure as conversion or theft where permitted by law.

Renter waives any claim for trespass or damage arising from lawful repossession, except as prohibited by law.

SECTION 25 - CLEANING AND CONDITION ON RETURN
Renter shall return the Trailer in the same condition as received, ordinary wear excepted, free of trash, debris, excess mud, grease, hazardous residue, and fluid leaks.

If the Trailer requires unusual cleaning, decontamination, debris removal, or hazardous-material cleanup, Renter shall pay all associated costs.

SECTION 26 - MISSING OR DAMAGED EQUIPMENT
Renter is responsible for repair or replacement of all missing or damaged equipment, including but not limited to ramps, safety chains, pins, jack, winch components, straps, chains, lights, wiring, spare tire, tie-down hardware, locks, and coupler parts.
Replacement cost may include parts, labor, shipping, downtime, and administrative handling.

SECTION 27 - NO WAIVER
Owner's failure to enforce any provision of this Agreement shall not be deemed a waiver of any right or remedy.

SECTION 28 - DEFAULT
Renter is in default if Renter fails to pay any amount due, returns the Trailer late, provides false information, uses the Trailer in a prohibited or unsafe manner, allows unauthorized possession or use, damages or loses the Trailer, or violates any material provision of this Agreement.

SECTION 29 - LIMITATION OF OWNER LIABILITY
To the fullest extent permitted by law, Owner shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost time, lost business, loss of use, hotel costs, freight costs, substitute transportation, or delay damages.
If any liability is imposed on Owner notwithstanding this Agreement, Owner's liability shall not exceed the amount actually paid by Renter for the rental, except where prohibited by law.

SECTION 30 - COMPLIANCE WITH LAW
Renter shall comply with all applicable federal, state, and local laws, regulations, ordinances, and roadway restrictions, including towing, securement, registration, and safety requirements.

SECTION 31 - NO ASSIGNMENT
Renter may not assign this Agreement or transfer any right or obligation under it without Owner's prior written consent.

SECTION 32 - GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the State of California, without regard to conflict-of-law rules.

Any dispute arising out of this Agreement shall be brought in the state or federal courts located in Riverside, California, and the parties consent to that venue and jurisdiction unless applicable law requires otherwise.

SECTION 33 - ATTORNEYS' FEES
In any action arising from or relating to this Agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs to the extent permitted by law.

SECTION 34 - SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law.

SECTION 35 - ENTIRE AGREEMENT
This Agreement, together with any inspection form, invoice, price sheet, damage waiver, and any written addendum signed by the parties, constitutes the entire agreement between the parties and supersedes all prior discussions or understandings.

SECTION 36 - AMENDMENTS
No amendment or waiver is effective unless in writing and signed by Owner.

SECTION 37 - ELECTRONIC SIGNATURES & RECORDS
Electronic signatures and electronically stored records shall be treated as originals to the extent permitted by law.

SECTION 38 - ACKNOWLEDGEMENT
By checking the box "I have read and agreed to the terms" before adding the Trailer to the Shopify cart, Renter acknowledges and agrees to all terms of this Agreement, has had the opportunity to ask questions, understands towing and loading risks, accepts responsibility for the Trailer during the Rental Period, and received the Trailer in acceptable condition unless otherwise noted in writing.
